Term of Service

Welcome to the S91 Platform (“S91”, “Platform”) and/or S91 mobile application (“App”) (where applicable). S91 operates as an online marketplace that enables users to create, list, purchase, and trade digital products.

Before registering or using any services, please review this Agreement carefully. This document forms a legally binding contract between you (“User”) and S91, outlining both parties’ rights and obligations. By creating an account or accessing the Platform, you agree to be bound by these terms.

1. Agreement Formation and Parties

1.1 The S91 Platform is owned and operated by S91. (“Company”), which retains all ownership, intellectual property rights, and operational control. All services are conducted in accordance with Malaysian laws and platform policies.
1.2 This Agreement becomes effective upon your acceptance during registration. Once completed, you are officially recognized as a registered user of S91.

2. Account Registration and Management

2.1 Eligibility Users must be at least 18 years old and legally capable of entering contracts. Minors may only use the Platform under supervision of a legal guardian.
2.2 Registration Details Accounts may be created via phone number, email, or third-party login. Users must ensure all submitted information is accurate and complete.
2.3 Account Security Users are responsible for safeguarding login credentials. Any loss due to negligence will be borne by the user.
2.4 Verification S91 may require identity verification for certain features. Providing false or misleading information may result in restricted access.
2.5 Account Actions S91 reserves the right to suspend, restrict, or terminate accounts that violate rules or laws.
2.6 Prohibited Content Users must not upload or distribute illegal, harmful, offensive, infringing, or spam-related content. Violations may result in removal and legal action.
2.7 User Conduct Users must not impersonate others, spread malware, disrupt services, or violate third-party rights.
2.8 Responsibility All activity under an account is the user’s responsibility. Any unauthorized use must be reported immediately.

3. Platform Services

3.1 Scope Services provided are based on official platform descriptions and may change over time.
3.2 Changes S91 may modify or discontinue services without prior notice.
3.3 Paid Features Certain services require payment. Fees are generally non-refundable unless required by law.
3.4 Orders Users must verify order details before confirming payment. Orders become valid once payment is completed.
3.5 Modifications Changes are allowed before payment. After payment, users must contact support.

4. Payments and Account Balance

4.1 Users may top up via approved payment channels after agreeing to relevant terms.
4.2 Top-up balances are non-transferable and cannot be withdrawn.
4.3 Users must maintain valid payment methods.
4.4 Funds are credited upon successful transaction.
4.5 Users acknowledge risks associated with blind box or draw-based activities and accept any financial outcomes.

5. Refund Policy

5.1 Top-ups are strictly for platform usage. Users must confirm details before payment.
5.2 All payments are final unless there is a verified system error (e.g., duplicate charge).
5.3 User mistakes (e.g., wrong amount, misuse, third-party access) are not valid grounds for refunds.
5.4 Completed payments are treated as final confirmation.
5.5 Draw results are random. Once completed, no refund or compensation will be given based on dissatisfaction.
5.6 Top-up funds cannot be withdrawn. Only earnings from selling digital items may be eligible for withdrawal, subject to rules.
S91 retains final authority over all decisions related to payments and refunds.

6. Data Protection and Privacy

6.1 S91 complies with Malaysia’s Personal Data Protection Act (PDPA).
6.2 User data may be used to improve services with consent.
6.3 Third-party services must follow similar data protection standards.
6.4 Continued use implies acceptance of updated privacy policies.

7. Disclaimer and Liability

7.1 Users accept risks associated with online content sharing.
7.2 S91 does not guarantee uninterrupted service.
7.3 S91 is not liable for force majeure events.
7.4 Users are responsible for their own content.
7.5 S91 may take action to protect its legal interests.
7.6 Maximum liability shall not exceed MYR500 or total fees paid in the past 12 months, whichever is higher.

8. Violations

8.1 S91 may warn, suspend, or terminate accounts for violations.
8.2 Users are responsible for legal consequences of their actions.
8.3 Intellectual property must be respected.
8.4 Fines up to MYR1,000 may be imposed for serious violations.

9. Minor Protection

9.1 Minors must be supervised.
9.2 Minor data is protected under PDPA.
9.3 Proper usage guidelines must be followed.
9.4 Guardians are responsible for spending. Refunds may be denied without sufficient proof.

10. Account Deactivation

Users may request account closure and balance handling through customer support.
10.1 Valid ID and payment details are required.
10.2 Information must match registered account details.
10.3 Requests may be rejected if verification fails or fraud is suspected.

11. Agreement Updates

11.1 S91 may revise this Agreement when necessary.
11.2 Continued use indicates acceptance of changes.

12. Termination

12.1 Accounts may be terminated for violations or service discontinuation.
12.2 Data may be retained as required by law.
12.3 Outstanding obligations remain enforceable.

13. Governing Law

13.1 This Agreement is governed by Malaysian law.
13.2 Disputes will first be negotiated, then resolved in Malaysian courts.
13.3 Invalid clauses do not affect remaining terms.
13.4 English version prevails in case of conflict.

14. Communication

14.1 Notices may be sent via platform, email, or registered contact details.
14.2 Public announcements may also be used.

15. Assignment

15.1 Users cannot transfer rights without written approval.
15.2 This Agreement binds all successors and legal representatives.
